MuseScope Terms of Use

1. Introduction and acceptance

Welcome to MuseScope — an art companion that recognises artworks, tells their stories, and helps you explore artists and museums.

These Terms of Use ("Terms") govern the MuseScope website at musescope.app (the "Website"), the MuseScope iOS application (the "App"), and the related backend services (together, the "Service"). They apply whenever you visit the Website, install or use the App, create an account, use artwork recognition, ask the AI guide a question, purchase or restore a subscription, or access MuseScope content.

By accessing or using MuseScope, you agree to these Terms. If you do not agree, do not use the Service. If you create an account, we will ask you to accept these Terms explicitly and to acknowledge the Privacy Policy at that time.

A few definitions used throughout: an Account is a registered MuseScope user account. Content means the text, images, artwork metadata, audio, stories, tours, translations, interfaces and other material available through MuseScope. Free Features are functionality available without a paid subscription; Premium is paid, subscription-based access to additional features or content. User Content means photographs, avatars, questions, feedback and other material you submit. Recognition Input is an artwork or label image you submit for recognition, and the AI Guide is the conversational AI-powered art guide.

2. Operator and contact

MuseScope is operated by Igor Fomin ("MuseScope," "we," "us," or "our").

3. Apple's Standard EULA

If you download or use the MuseScope application through Apple's App Store, your licence to use the application is also subject to Apple's Standard Licensed Application End User License Agreement. These Terms supplement Apple's Standard EULA with respect to MuseScope accounts, subscriptions, content, and services. If there is an unavoidable conflict, Apple's Standard EULA controls to the extent that it applies to the App or to content, materials, or services accessed or purchased through the App.

Apple is not a party to these Terms and does not sponsor or endorse MuseScope, but Apple and its subsidiaries may enforce rights that arise under Apple's own agreements and terms.

4. Eligibility and age

You must be at least 13 years old to create an Account or use account-based features. If the law where you live requires parental or guardian authorisation before you can use an online service, you may use MuseScope only with that authorisation. You must also be legally capable of accepting these Terms.

MuseScope is not directed specifically at children under 13. We do not verify every user's age, but we may close an Account where we reasonably believe the user does not meet the applicable age requirements.

5. Guest use and Accounts

Significant parts of MuseScope are available without registration. An Account is required for features such as favourites, likes, recognition history, synchronisation between devices, Premium access, personalised recommendations, and profile management.

You can sign in with Google Sign-In, Sign in with Apple, or an email one-time code. We do not promise that every sign-in method will remain available permanently.

When you create or use an Account, you agree to:

  • provide accurate information;
  • maintain control over the email address, Google account, or Apple Account you use to sign in, and keep that access secure;
  • tell us at support@musescope.app if you suspect unauthorised use of your Account;
  • not sell, transfer, lend, or share an Account in a way that circumvents subscription restrictions.

You are responsible for activity carried out through your Account unless the activity resulted from a security failure within MuseScope's control.

6. Your licence to use MuseScope

We grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable, non-commercial right to use the Service in accordance with these Terms. This covers ordinary personal, museum, and educational use — exploring the catalogue, scanning artworks on your visits, listening to stories, asking the AI Guide questions.

This licence does not permit you to:

  • resell the Service or operate paid tours using MuseScope Content without our permission;
  • copy, republish, or extract substantial parts of the catalogue or database;
  • redistribute audio stories or commercially exploit our translations;
  • build a competing database or product from MuseScope Content;
  • use MuseScope Content to train an AI or machine-learning system;
  • remove rights notices, credits, or attribution;
  • circumvent technical restrictions or subscription controls.

The licence to the App itself is additionally governed by Apple's Standard EULA (section 3).

7. Free and Premium features

MuseScope may provide both Free Features and paid Premium features. Premium may include expanded access to stories and tours, additional audio or narrated content, AI-powered guide functionality, enhanced recognition features, personalisation, offline functionality, or other advanced features. The specific features included with each subscription are displayed in the App before purchase, and that in-app description is the authoritative description of the current plan.

The availability and composition of Free and Premium features may evolve as MuseScope is developed. Features may vary by app version, language, country, device, and technical availability; not every feature is available for every artwork, artist, museum, or language; and Premium features may include reasonable use limits (see section 20). Premium does not necessarily mean unlimited AI requests, unlimited processing, or permanent access to every item.

We will not intentionally remove the essential value of an active paid subscription during its current paid period, except where a change is reasonably necessary for legal, security, safety, licensing, or technical reasons.

8. Subscriptions and billing

Subscriptions purchased through the App Store are billed and managed by Apple. Payment is charged to your Apple Account. MuseScope never receives your payment-card numbers, bank details, or Apple Account password.

MuseScope may offer a monthly and an annual auto-renewable subscription. Current subscription periods, prices, currencies, taxes, and introductory-trial details are displayed by Apple in the App before purchase.

Auto-renewable subscriptions renew automatically for the same subscription period until cancelled through your Apple Account. Cancelling stops the next renewal; it normally does not remove access you have already paid for, which continues to the end of the current subscription period. Deleting the App or your MuseScope Account does not cancel an Apple subscription — manage or cancel subscriptions in your Apple Account settings.

9. Free trial

An introductory free trial may be available to eligible users who select the annual subscription. The trial duration, eligibility, renewal price, and the date on which billing begins are displayed before purchase. Apple determines eligibility for introductory offers; not every user is eligible, and a user is generally eligible for only one introductory offer in a subscription group.

Unless cancelled before the trial ends, the annual subscription automatically begins and Apple charges the price shown at the time of purchase. To avoid being charged after a free or discounted trial, cancel through your Apple Account at least 24 hours before the trial ends.

10. Cancellation, restoration, and refunds

Cancellation. Subscriptions are cancelled through your Apple Account (Settings → your name → Subscriptions), not by contacting MuseScope or deleting the App.

Restoration. Your subscription entitlement is linked to your MuseScope Account so Premium can be restored on your other devices and after reinstalling the App. One Apple subscription may be linked to only one active MuseScope Account at a time. Restoring a purchase restores an eligible subscription entitlement; it does not restore personal data that was previously deleted with a MuseScope Account.

Refunds. App Store purchases and refunds are administered by Apple under Apple's applicable policies. MuseScope cannot directly issue or guarantee an App Store refund, but our support can point you to the right Apple process. Nothing in these Terms limits refund rights you have under mandatory consumer law.

Price changes. Prices may vary by country, currency, tax treatment, and Apple storefront. Apple displays the current price before purchase and handles any required notice or approval for price changes to an existing subscription; you can always cancel before a renewal. If we discontinue a subscription, we will stop offering it to new users, give existing subscribers reasonable advance notice, and either preserve reasonable value through the paid period or direct affected users to Apple's refund process.

11. Deleting your Account while a subscription is active

You can delete your Account at any time from the App, including while a subscription is active. Deleting your MuseScope Account will not cancel the subscription, stop future Apple billing, or automatically provide a refund — to prevent renewal, cancel the subscription through your Apple Account first.

After deletion, your personal data is removed as described in the Privacy Policy. The active link between the subscription and the deleted Account is released; a minimal, pseudonymised transaction record may be retained for entitlement restoration, fraud prevention, accounting, and legal obligations. If your subscription is still active, you can restore the entitlement to a new Account with Restore Purchases — but your deleted favourites, history, chats, and other personal data are not restored.

12. MuseScope Content

MuseScope provides educational and cultural information about artworks, artists, museums, architecture, art history, and related subjects — editorial text, translations, narration and audio, artist biographies, museum information, AI-generated responses, and recognition results.

We make reasonable efforts to provide accurate and useful information, but art-historical attribution, dates, titles, translations, ownership information, and scholarly interpretations may differ between sources and may change over time.

MuseScope Content is not: an official museum record (unless explicitly stated), a certificate of authenticity, a provenance report, an artwork appraisal, a legal copyright opinion, a substitute for professional conservation advice, or a guaranteed scholarly conclusion.

13. Public-domain and licensed artworks

MuseScope primarily presents artworks and images that we believe are in the public domain, are used under an applicable licence or permission, or may otherwise lawfully be presented. Copyright duration and permitted use vary between countries. An artwork, photograph, reproduction, text, or other item may therefore be available in one context or territory but unavailable in another.

MuseScope may include protected works where permission has been obtained from an artist, museum, estate, collection, photographer, agency, or other relevant rights holder.

MuseScope does not guarantee that every notable artist or artwork will be included. An artist, artwork, image, audio item, or feature may be unavailable because of copyright restrictions, licensing limitations, regional differences, unavailable source material, editorial decisions, or technical limitations.

Separate rights may exist in the underlying artwork, a photograph of it, a museum's digital reproduction, catalogue text, metadata arrangement, translations, audio narration, and MuseScope's editorial presentation. The appearance of an artwork in MuseScope does not grant you permission to commercially reproduce, distribute, publish, merchandise, or otherwise exploit that artwork or its digital reproduction. You are responsible for determining whether your intended reuse of any third-party material is lawful.

Certain recognition and indexing functions may process limited, lower-resolution, non-display, or machine-readable technical representations of protected works where permitted by applicable law or applicable licence terms. These representations are used for identification, comparison, indexing, and recognition, and are not offered to users as substitutes for authorised reproductions of the original artwork.

14. Artwork recognition

Artwork recognition is a best-efforts identification tool. Recognition results are generated automatically and may be inaccurate, incomplete, or unavailable. MuseScope does not guarantee that an artwork, label, artist, or museum will be correctly identified.

Recognition is not authentication, expert attribution, provenance verification, condition assessment, valuation, appraisal, or ownership verification. Do not rely on MuseScope recognition results to authenticate, purchase, sell, insure, restore, transport, or value an artwork.

When you use recognition, you must follow museum photography rules, posted restrictions, staff instructions, applicable laws, and the privacy rights of people around you. If you allow location access, approximate location may improve recognition, but it does not guarantee accuracy; the App is fully usable without location permission.

15. AI art guide

The AI Guide produces automatically generated responses about art, artists, museums, architecture, history, and related cultural and educational topics. It may refuse or redirect questions outside those subjects.

AI-generated responses are provided for general cultural and educational use. They are not guaranteed scholarly, curatorial, legal, financial, professional, or factual conclusions. Answers may contain errors, be incomplete, reflect uncertainty or conflicting scholarship, misunderstand a question, or be temporarily unavailable. Verify important information against primary or authoritative sources.

AI Guide access may depend on Premium status and may be rate-limited; limits may vary with system capacity and abuse prevention. We may update AI models, change providers, modify limits, temporarily suspend AI functions, and refuse abusive or irrelevant requests. Any material limit likely to affect an ordinary paying user is disclosed in the App.

16. User photographs and other User Content

You retain any rights you have in photographs, profile images, questions, and other material you submit. You grant MuseScope a limited, non-exclusive, worldwide, royalty-free licence to host, copy, transmit, crop, transform, analyse, and otherwise technically process that material only as reasonably necessary to provide the requested service, maintain security, prevent abuse, and comply with law.

This licence is limited to operating the Service. It does not allow us to sell your photographs, use them for advertising, or use them to train AI models, and it ends when the data is deleted, except for temporary backups and legal obligations described in the Privacy Policy. How long recognition photographs, chat context, and other data are kept — and which providers process them — is described in the Privacy Policy.

By submitting User Content you confirm that you are permitted to submit it for the requested function, that doing so does not knowingly violate another person's rights, that you will not upload illegal or malicious content, and that you follow museum rules when photographing.

Avatars. You may upload a profile image. Avatars must not contain unlawful content, malware, impersonation, harassment, explicit sexual content, hateful or threatening content, or material that clearly infringes third-party rights. We may remove a violating avatar or reset it to a default. Your profile is not visible to other users.

Feedback. If you send us ideas, suggestions, corrections, or other feedback about MuseScope, you allow us to use that feedback to improve the Service without payment or obligation to you. This does not transfer ownership of your photographs, your identity, support correspondence, or unrelated creative works.

17. Intellectual property owned by MuseScope

MuseScope or its licensors retain all rights in the Service's software, source code, interfaces, branding, logos, database selection and arrangement, original editorial writing, narration and audio production, original translations and illustrations, graphic design, recognition systems, and non-public datasets. These Terms do not transfer any ownership to you.

The MuseScope name, logo, and visual identity may not be used to imply sponsorship, partnership, endorsement, or affiliation without our written permission.

18. Copyright and intellectual property concerns

MuseScope makes reasonable efforts to respect intellectual property rights. If you believe that material available through MuseScope infringes rights that you own or are authorised to represent, contact support@musescope.app with: your full name and contact details; identification of the protected work; identification (ideally the URL) of the MuseScope material; an explanation of the claimed rights and why the use is allegedly unauthorised; evidence that you own or represent the rights; and a statement that the information supplied is accurate.

We will review sufficiently detailed notices promptly and may remove or restrict access to material where appropriate. We may request additional information, temporarily restrict content while reviewing, replace an image, correct attribution, limit access by territory, restore content if a complaint is unsupported, and keep records of complaints.

19. Prohibited use

You must not:

  • violate applicable law, or use recognition or AI functions for abusive or fraudulent purposes;
  • access another user's Account, impersonate another person, or sell or transfer Accounts;
  • share subscription access in a way that circumvents intended licensing, bypass a paywall, manipulate entitlements, or use stolen payment credentials;
  • attack, probe, or disrupt the Service, upload malware, or attempt unauthorised access;
  • reverse engineer the Service except where the law expressly permits it;
  • scrape the Service, extract data in bulk, use bots without permission, or reproduce substantial portions of the catalogue;
  • use MuseScope Content to train external AI systems;
  • remove watermarks, credits, or rights notices;
  • harass staff or other users, or submit unlawful content;
  • misrepresent MuseScope output as a professional authentication or appraisal.

Ordinary indexing of the public Website by standard search engines, the use of accessibility tools, personal bookmarking, and normal sharing of public page links are all fine.

20. Usage limits

We may apply reasonable technical and usage limits — for example on AI questions, recognition requests, concurrent sessions, account creation, automated access, storage, or repeated failed sign-ins — to protect the Service, control abuse, maintain availability, and manage third-party processing costs. Where a numerical limit is likely to affect an ordinary Premium user, we show it on the paywall or the relevant feature screen.

21. Third-party services

MuseScope depends on services supplied by third parties such as Apple, Google, Microsoft Azure, OpenAI, and Anthropic, and links to museum and collection websites and other external resources. We do not control third-party services; they have their own terms and privacy policies, and their availability may affect MuseScope. Links do not imply endorsement. You must comply with applicable third-party terms — including Apple's App Store terms when using the App.

22. Privacy

Our Privacy Policy at musescope.app/privacy explains how MuseScope processes personal information. It applies alongside these Terms but does not replace any consent or permission that must be obtained separately.

Accepting these Terms is not consent to optional analytics cookies or marketing, and it does not grant camera, photo-library, or location permissions. These permissions are requested separately. Declining an optional permission may prevent the particular feature that depends on it from working, but other parts of MuseScope will remain available. Location remains fully optional for recognition.

23. Suspension and termination

We may suspend or terminate access to the Service where reasonably necessary because of a material violation of these Terms, fraud, payment abuse, security threats, unlawful activity, attempts to harm the Service, repeated infringement, legal requirements, or sanctions or platform restrictions. Where reasonable, we will provide notice, explain the general reason, and let you contact support; immediate suspension may occur for urgent security, fraud, or legal reasons.

Suspension or termination of a MuseScope Account does not automatically cancel an Apple subscription — manage the subscription separately through Apple. Where an Account with an active subscription is suspended or terminated, we will provide information about managing or cancelling the Apple subscription where reasonably possible. If we terminate an Account for serious misuse, we do not promise a direct refund; Apple's refund processes and mandatory consumer law remain applicable. Your own right to delete your Account (section 11) is separate from enforcement termination.

24. Service changes and availability

MuseScope is provided on an "as available" basis. We may perform maintenance, fix errors, change models or providers, add or remove content, update translations, change recognition logic, temporarily restrict features, remove content for licensing reasons, alter language availability, and discontinue support for older devices or operating-system versions.

We do not promise uninterrupted access, permanent availability of any particular artwork, museum, or AI provider, error-free recognition, or permanent offline availability. Where a material Premium feature is permanently discontinued, we will take reasonable steps to preserve the remaining value of active subscriptions, provide notice where appropriate, or direct affected users to Apple's available refund process.

25. Warranty disclaimer

MuseScope is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we do not guarantee that the Service will always be available, uninterrupted, secure, error-free, complete, or accurate — including, specifically, artwork recognition, AI responses, art-historical accuracy, translations, museum opening information, attribution, copyright status, third-party content, device compatibility, and feature availability.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

26. Limitation of liability

To the maximum extent permitted by law, MuseScope is not liable for indirect or consequential losses, loss of profit or business, losses caused by reliance on inaccurate recognition or AI output, losses caused by third-party-service unavailability, museum access or photography disputes, or losses caused by unauthorised Account use outside MuseScope's control.

To the maximum extent permitted by law, MuseScope's total liability arising from the Service will not exceed the greater of: (a) US$50; or (b) the total amount you paid for MuseScope subscriptions during the 12 months immediately preceding the event giving rise to the claim.

These limitations do not apply where the law does not allow them to — including liability for fraud or wilful misconduct, liability that mandatory consumer law preserves, and any liability for death or personal injury caused by negligence where such liability cannot be excluded.

27. Limited indemnity

To the extent permitted by applicable law, you are responsible for reasonable, documented losses, liabilities, and costs arising from a third-party claim caused directly by your deliberate unlawful misuse of the Service, fraudulent conduct, attacks on MuseScope systems, or User Content that you knowingly had no right to submit. This does not apply to ordinary use, accidental errors, or matters caused by MuseScope Content or conduct.

28. Governing law and disputes

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. This choice of law does not deprive you of mandatory consumer protections that apply in the country where you live.

Subject to any mandatory right you have to bring a claim in another jurisdiction, disputes relating to these Terms will be submitted to the competent courts of Israel.

Before bringing a formal claim, you are encouraged to contact support@musescope.app so that we can attempt to resolve the issue.

29. Changes to these Terms

We may update these Terms as MuseScope evolves. The effective date, last-updated date, and version above always reflect the current revision. For minor changes, publishing the updated document is sufficient; for material changes, we will provide reasonable notice in the App, on the Website, or by essential account email, and where legally required we will ask for renewed acceptance.

Changes will apply from the stated effective date. They will not retroactively alter subscription rights already earned or payments already completed, except where required by law or necessary to address security, abuse, or legal compliance.

30. Communications

We may send essential communications about account security, authentication, subscription status, service changes, legal notices, material changes to these Terms, and support. Accepting these Terms is not consent to marketing email — MuseScope does not send marketing email.

Notices may be sent to the email address associated with your Account and, for material matters, shown inside the App where practical. A notice may not reach you if your email address is outdated or delivery is blocked; please keep your sign-in email current.

31. General provisions and contact

Entire agreement. These Terms, Apple's Standard EULA, and the purchase information displayed by Apple form the contractual agreement concerning your use of MuseScope. The Privacy Policy separately explains how personal information is processed.

Severability. If one provision is unenforceable, the remainder remains effective. No waiver. Not enforcing a provision immediately does not waive the right to enforce it later. Assignment. You may not transfer this agreement without our permission; MuseScope may transfer operation of the Service as part of a legitimate reorganisation, sale, or transfer, subject to applicable privacy and consumer law. Headings are for convenience only. Language. The English version of these Terms is authoritative unless local law requires otherwise. No third-party beneficiaries, except Apple where rights arise under Apple's Standard EULA or applicable Apple terms.
